Terms of Service & Forensic Evidentiary Disclosures

Corporate Entity Identification

The enterprise consulting services, technical security audits, digital forensic analyses, source-code remediation, and staging architectures provided under the brand Internet Security Consultants are owned and operated exclusively by Call Center Options, LLC, a Florida limited liability company (“Company”, “we”, “us”, or “our”), with principal offices located in Jacksonville, Florida. By accessing our web properties, requesting technical diagnostics, retaining consulting services, or executing statements of work, you (“Client”, “Organization”, or “User”) agree to be legally bound by these Terms.

1. Independent Forensic Technical Contractor & Express "No Legal Advice" Disclaimer

MANDATORY STATUTORY NOTICE: Call Center Options, LLC d/b/a Internet Security Consultants (a Florida limited liability company) is an independent technical engineering, digital forensic, and cybersecurity consulting firm. We are not a law firm, our consultants and forensic engineers are not licensed attorneys, and our technical assessments, source-code remediations, and deliverables do NOT constitute legal representation, legal opinions, or licensed legal advice.

All diagnostic audits, Web Content Accessibility Guidelines (WCAG) 2.1 Level AA conformance reports, FTC Safeguards gap analyses, and litigation defense technical briefings are purely factual engineering deliverables. While our structural code refactoring produces technical documentation that counsel may consider when evaluating legal defenses—including the Voluntary Cessation and Mootness Doctrine under established 11th Circuit precedent (Sheely v. MRI Radiology Network, P.A., 505 F.3d 1173) and 42 U.S.C. § 12188(a)(1)—all legal decisions, procedural motions, answers to complaints, Rule 12(b)(1) dismissal pleadings, and settlement negotiations must be conducted exclusively by the Client's retained licensed legal counsel.

2. Technical Evidentiary Scope & Judicial Discretion

Technical audits and WCAG conformance reports provided by Company represent point-in-time forensic evaluations of digital assets utilizing industry-recognized testing engines (including Axe-Core, Google Lighthouse, screen reader simulation, and manual keyboard navigation inspection).

Company does not guarantee, warrant, or represent that any technical audit, code refactoring, or staging deployment will automatically prevent third-party demand letters, eliminate active lawsuits, or guarantee a specific judicial outcome. Judicial determinations of standing, mootness, and fee-shifting under Title III of the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act, or the FTC Safeguards Rule remain within the sole constitutional and statutory discretion of presiding federal and state courts.

3. Third-Party Embeds, Iframes, & Client-Controlled Systems

Company's scope of work applies strictly to source code and assets directly authored, hosted, or refactored by Company. Company disclaims all liability for accessibility or security defects arising from:

  • Third-party iframe widgets, including real estate MLS embeds and unmanaged payment gateways;
  • Third-party marketing scripts, tracking tags, and analytics pixels inserted by Client or external marketing agencies without prior forensic code verification;
  • Modifications, theme changes, or unverified CMS plugin additions executed by Client or unauthorized third parties after our technical review;
  • Legacy third-party PDF, Word, or spreadsheet attachments not explicitly included in the written scope of work.

4. Strict Limitation of Liability

PLEASE REVIEW THIS CLAUSE CAREFULLY AS IT DEFINES AND LIMITS OUR FINANCIAL LIABILITY.

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL CALL CENTER OPTIONS, LLC D/B/A INTERNET SECURITY CONSULTANTS (A FLORIDA LIMITED LIABILITY COMPANY), ITS DIRECTORS, OFFICERS, AFFILIATES, TECHNICAL CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR STATUTORY DAMAGES WHATSOEVER—INCLUDING BUT NOT LIMITED TO:

  • Civil rights damages, settlements, or injunctive decrees entered in federal or state court;
  • Opposing counsel statutory attorney fee awards or cost recoveries;
  • Lost profits, loss of business goodwill, or regulatory fines assessed by the FTC or state Attorneys General;
  • Operational downtime or data transmission delays beyond Company's direct control.

COMPANY'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO ANY AUDIT, ADVISORY REPORT, OR TECHNICAL REMEDIATION SHALL UNDER NO CIRCUMSTANCES EXCEED THE GREATER OF FIVE HUNDRED DOLLARS ($500.00 USD) OR THE TOTAL CONSULTING OR RETAINER FEES ACTUALLY PAID BY CLIENT TO COMPANY IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE OCCURRENCE GIVING RISE TO LIABILITY.

5. Mutual Indemnification & Client Representation

Client represents and warrants that all digital content, copyrighted imagery, customer data, and branding assets provided to Company are lawfully owned or properly licensed by Client. Client agrees to defend, indemnify, and hold harmless Call Center Options, LLC and its officers from and against any third-party claims, liabilities, damages, and legal fees arising from: (a) Client's breach of these Terms; (b) intellectual property infringement by Client-supplied assets; or (c) modifications made to digital assets by Client or third-party marketing vendors contrary to Company's technical specifications.

6. Governing Law, Venue, & Jurisdiction

These Terms, and any dispute, controversy, or claim arising out of or related to Company's consulting services, shall be governed by, construed, and enforced in accordance with the substantive laws of the State of Florida, United States, without regard to conflict of laws principles. Any legal action, suit, or proceeding arising under or related to these Terms shall be instituted exclusively in the state or federal courts located in Duval County, Florida (including the United States District Court for the Middle District of Florida, Jacksonville Division). The parties hereto irrevocably submit to the personal and subject-matter jurisdiction of such courts and waive any objection grounded in forum non conveniens.

đź”’ Privacy Policy & Data Protection Notice

Effective Date: October 18, 2026 • Scope: All Public Web Properties & Diagnostic Portals

🛡️ Privacy-First Engineering Principle

Call Center Options, LLC d/b/a Internet Security Consultants (a Florida limited liability company) operates under a strict, privacy-by-design architecture. We collect only the minimum technical information necessary to deliver forensic audits, maintain network defense, and assist commercial organizations and their legal counsel. We do not sell, rent, monetize, or broker personal data. We do not engage in cross-context behavioral advertising, and we employ zero third-party marketing pixels.

8.1 Data Controller Identification

For the purposes of applicable data privacy legislation—including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), the Florida Digital Bill of Rights (FDBR), the General Data Protection Regulation (GDPR), and related state statutory privacy enactments—the data controller responsible for the processing of your information is:

8.2 Categories of Information Collected

Depending on how you interact with our website, we collect two distinct categories of information:

Category A: Voluntary Technical Intake Data

Information you voluntarily provide when requesting a baseline WCAG technical audit or litigation intake:

  • Business organization or corporate client name;
  • Target domain name or website URL to be audited;
  • Professional contact email address;
  • Optional litigation docket number or court case reference;
  • Technical notes regarding existing overlay widgets or CMS platforms.
Category B: Automated Edge Diagnostic Telemetry

Technical telemetry automatically captured by our edge delivery network and reverse proxies:

  • Client Internet Protocol (IP) address (masked/anonymized in analytics);
  • Browser user-agent, operating system, and screen resolution;
  • HTTP request timestamps and referring URLs;
  • Consent preference token stored in your browser's local storage (isc_cookie_consent).
Notice Regarding Sensitive Personal Information: We do NOT collect Social Security numbers, driver's license numbers, racial or ethnic origin, biometric identifiers, or consumer financial payment cards on this public website.

8.3 Purpose of Processing & Lawful Bases

We process collected data exclusively under the following established lawful grounds:

1. Performance of Pre-Contractual & Contractual Steps: Processing intake submissions to perform initial accessibility scans, capture baseline DOM evidence, and deliver diagnostic findings to prospective clients or their retained legal counsel.
2. Legitimate Business Interests: Preserving perimeter network security, mitigating Distributed Denial of Service (DDoS) threats, preventing abusive or automated scraping, and verifying system uptime.
3. Express User Consent: Measuring website performance and reader engagement via Google Analytics 4 strictly when you have provided explicit affirmative consent via our cookie consent banner.

8.4 Sub-Processors & Service Providers

We engage a strictly limited group of enterprise service providers who process data on our behalf under compliant Data Processing Agreements (DPAs):

  • Cloudflare, Inc. (USA): Edge content delivery network, reverse proxy, DDoS mitigation, and cookieless performance telemetry.
  • Google LLC (USA) — Google Analytics 4: Aggregate site traffic measurement. Strictly consent-gated: GA4 is never initialized unless you explicitly click "Accept" on our consent banner. IP anonymization is permanently enabled.
  • Amazon Web Services, Inc. (USA): Secure transactional email delivery (Amazon SES) relaying intake inquiries over TLS-encrypted SMTP channels.

We maintain zero integrations with data brokers, ad networks, or social tracking pixels (no Meta Pixel, TikTok, or LinkedIn tracking tags).

8.5 Data Retention Schedules & Evidentiary Archival

Routine edge telemetry logs are retained for thirty (30) days and automatically purged. Technical intake submissions, baseline DOM snapshots, and code audit deliverables are preserved in isolated, encrypted staging sandboxes for as long as necessary to support retained defense counsel during litigation or regulatory review windows (typically three (3) years), after which they are securely expunged in accordance with DoD 5220.22-M sanitation standards.

8.6 Technical & Cryptographic Security Measures

We implement rigorous organizational and technical safeguards:

  • Mandatory Transport Layer Security (TLS 1.3 / HTTPS) with HTTP Strict Transport Security (HSTS) headers;
  • Decoupled containerized architectures with zero public-facing database endpoints;
  • Least-privilege administrative access controls protected by multi-factor authentication (MFA);
  • Isolated staging sandboxes preventing spoliation or unintentional alteration of baseline evidence.

8.7 Your Statutory Privacy Rights (CCPA / CPRA, GDPR, Florida FDBR)

Depending on your geographic jurisdiction, you possess specific legal rights regarding your personal information:

Right to Know & Access: You may request disclosure of the specific pieces and categories of personal information we have collected about you.
Right to Deletion: You may request the permanent deletion of personal information we have collected from you, subject to evidentiary retention exemptions.
Right to Correct: You may request correction of inaccurate personal data maintained in our technical systems.
Right to Opt-Out: You may revoke consent for analytics tracking at any time using our Cookie Policy controls below.

We never discriminate against any client, attorney, or individual for exercising statutory privacy rights. To submit a verifiable Data Subject Access Request (DSAR), email our designated privacy team at [email protected]. We will confirm receipt within ten (10) business days and respond substantively within statutory timeframes.

8.8 Global Privacy Control (GPC) & Do-Not-Track

We honor automated Global Privacy Control (GPC) and Do-Not-Track (DNT) browser signals. If our edge systems detect a valid GPC or DNT signal, non-essential cookies and analytics scripts are automatically suppressed without requiring manual interaction.

8.9 Children's Online Privacy Protection

Our website and services are intended exclusively for commercial enterprises, corporate officers, and licensed attorneys. We do not knowingly solicit, collect, or process information from individuals under eighteen (18) years of age.
